We pride ourselves on our service and products and have many systems and quality checks in place to ensure you are completely satisfied.

We fully comply with UK Distance Selling Regulations.

We hope to never need to resort to the 'small print' but here it is, just in case, so that both parties know exactly where we stand!

Full Terms of Business

Definitions
'We', 'us' or 'the company' means Dive-Logs Ltd
'You', 'the customer' or 'the buyer' means the person, company or entity contracting to purchase the goods.
'The goods' are the items that you order from us as specified by our order acknowledgement and on our invoice.

Order Acceptance
We can receive orders via the company's web site, by phone, mail or e-mail using the contact methods published on our web site or in other publicity materials. We reserve the right to refuse to accept orders or to require additional confirmation at our discretion. We acknowledge receipt of your orders via an appropriate communication: For example, web-based orders are acknowledged automatically by e-mail, telephone orders are acknowledged verbally at time of order. Orders placed by telephone are accepted when the order is placed and a contract of sale then exists between us and you from that time. If orders are placed by mail or via our web site, no contract exists between you and the company until our official invoice has been issued. Please note that our products are not available for trade resale without our consent.

Refunds
If we acknowledge an order but, for some reason outside our control, we are unable to complete the transaction within 28 days then any payment made will be refunded immediately if you ask us to do so. Refunds due against returned goods will be paid as soon as the returned goods are received by us, subject to the goods being received in unused, undamaged condition in their original packaging.

Pricing
We endeavour to ensure that all published prices are correct, however we reserve the right to change prices without notice and not to accept orders at prices that have been quoted in error. Prices are quoted in three currencies. Pounds Sterling, Euros, and US Dollars. Prices in Euros and US Dollars are calculated using typical exchange rates but we have no control over the exchange rate that will be applied by your credit card or bank and so you should expect the final payment to vary slightly.

Tax Charges
UK Customers:
All orders are subject to VAT (20% for all items except books and gift certificates). Please look for the price in brackets with the words 'inc VAT' next to it.

International Customers:

Please note you cannot pay for an order from one country and deliver it to another. Please contact us first if you have this special need.

You WILL NOT PAY VAT (also known as GST in some countries) at time of purchase. However, you may need to pay a local duty and import VAT tax when you receive the order. More information will be available on your home countries customs website. However, as a service, we have found the following for our US and Canadian customers:

US Duty information:
The following information was copied from the US customs website Postal Imports section on 25th May 2008 (we cannot guarantee this has not been altered since!):
Packages whose declared value is under $200 ($100 if being sent as a gift to someone other than the purchaser) will generally be cleared without any additional paperwork prepared by CBP.

Canadian Duty information:

If someone mails you an item worth $20 CAN or less, you don't have to pay duty or tax on the item.

Payment
Payment is accepted in pounds sterling by most major credit or debit cards as detailed on our web site at time of order. Prices in other currencies in our brochures or web site are indicative only as international exchange rates will alter the final amount payed. We do not offer trade credit accounts.

Payment Security
All credit card or Paypal payments made during on-line transactions are handled on our secure server using the SagePay secure payment gateway and handled using SSL 128 bit encryption. No credit card details are stored at any time on the company's web site.

Delivery
We aim to despatch orders containing only stock items within 48 hours of receipt, subject to stock availability. Any orders containing made to order items will usually take an extra 3 days. Orders are delivered by the most appropriate method, usually first class post, or international small packet post. If any delays occur, we will endeavour to keep you informed. Although our delivery services indicate expected delivery times, these are subject to the possibility of a package being delayed or lost in transit. If delivery is delayed beyond 28 days, we will always give you the option of receiving a full refund of any payments that you have made. For extra security, please choose our upgraded delivery services that provide accelerated delivery and tracking.

Risk
Delivery is ex-works, Newcastle Upon Tyne, and risk passes to the customer on delivery.

Returns
We stand behind a 100% customer satisfaction guarantee. This means that any of our products may be returned to dive-logs.com for replacement or refund subject to the following (this does not affect your statutory rights):-

Cancellation of Order (NOT Faulty or Incorrectly Ordered Returns)
Under the United Kingdom Distance Selling Regulations 2000 you have a right to cancel your order without giving a reason for any item purchased on this website within a period of 14 working days, beginning with the day after the day on which the item is delivered. This applies to all of our products. However, we regret that we cannot accept cancellations of contracts where the item has been unsealed

To cancel your order, please first email us to let us know of your intent. Please then package the relevant items securely and send them to us with the delivery slip so that we receive them within 14 working days of the date that the item was delivered to you.

Please Note:
You must take care of the goods whilst they are in your possession, goods returned damaged or used can not be accepted. The return carriage is payable by the customer, the goods should be insured as it is your responsibility to return the goods to us in its original condition. We will not be held responsible for any damage or loss whilst the items are being returned to us.

We will then authorise a full refund. Please allow a maximum of 30 days for refunds to be processed and credited to your account. If you used a credit card to make your purchase we will credit the same card number.

Free exchange of items
We want you to be 100% satisfied with your purchase. If you want to change your mind and exchange your order for some other products of an equivalent value then simply send us an email. You will be responsible for posting the items back to us, but the exchange will be free. Please take care of the products you wish to exchange as we cannot accept them if they have been opened or damaged.

Cancellation of Order (Faulty or Incorrectly Ordered Returns)
If you are returning an item because of an error on our part or because the item is defective, we will be happy to either replace the product or offer a full refund for the price you paid for the item PLUS the cost in returning it to us. However, this is important: Please first contact us to let us know so that we can arrange all necessary details.

To return an item:
Simply return the item to the address detailed below. Please remember to enclose a copy of the delivery slip. Alternatively enclose your name, address (including postcode), e-mail address or daytime telephone number. In the case of a defective product, please provide a description of the fault.

Retention of Title
Whether or not delivery has been made, property in the goods does not pass from the company to the customer until full payment is received.

Specifications and Information
Goods are supplied subject to the company's standard specifications and, unless specifically agreed to the contrary, may be manufactured by any of our approved vendors. While we endeavour to publish and supply as much product and application data as possible, the company is unable to assess the viability of every possible application of the goods: It is the customer's duty to ensure that the goods ordered are suitable for the application in which they intend to use them. We endeavour to ensure that all published information is correct but the company shall not be under any liability for any direct, indirect or consequential damage, loss or expense that may be caused as a result of any error or omission in any information either published by or supplied by the company. Please note that exact colours and finishes are difficult to reproduce accurately on web sites and printed materials and that customers should not place undue reliance upon such reproductions.

Complaints
We aim to deal with any complaints in a fair and timely manner. Any complaints should be addressed in writing to the company at the published address or via email.

Indemnity
Customers and other users of this web site agree to indemnify the company against any claims, direct, indirect or consequential damage, loss or expense that may be caused as a direct or indirect result of the use of this web site and any information or computer software contained therein or by your access to other web sites as a result of links from this site. We make every effort to ensure that this web site does not contain any computer viruses but cannot guarantee this or warrant that it is virus-free.

Copyright Release
Some of our products allow you to use your own logo, or artwork within the product (examples include but are not limited to log book stamps, Scubatags, and Slates). By asking the company to make copies/prints of these you acknowledge that the company will not copy materials subject to someone else’s copyright, or that would be used for trademark infringement. You understand that you are confirming that you have the right to make copies/prints and that doing so will not infringe copyright or trademarks. You also understand that the company will be relying on your following statement: That you either own the material, have been given permission/license by the owner of the material to use and copy/print it, or that the material is in the public domain. You agree to indemnify, defend, and hold Dive-Logs harmless from any loss, demand, suit, damages, claim, or action arising out of your use of the materials. You agree to pay any judgement, loss, costs, and fees incurred by Dive-Logs in connection with such a suit, demand, claim, or damages.

eBooks Terms of Service
A subscriber’s access to and use of eBook(s) on the DiveLogs website is subject to the following terms and conditions:

License. DiveLogs hereby grants the Subscriber a worldwide non-exclusive, non-transferable, revocable, limited license to access online the eBook(s) via the DiveLogs website. The eBook(s) consists of DiveLogs owned and/or licensed content on select topics. Subscriber is licensed to use content made available to Subscriber in the eBook(s) (“Content”). If DiveLogs loses the right to offer any eBook Content, discontinues the service, or is otherwise unable to offer eBook Content, DiveLogs may terminate Subscriber’s access to the eBook(s). At DiveLogs' sole discretion and using commercially reasonable practices, DiveLogs may provide the Content in another media format in this case.

Limitations. Subscriber may not copy, download, print, scrape, store, publish, transmit, retransmit, transfer, distribute, disseminate, broadcast, circulate, sell, resell or otherwise use the Content, or any portion of the Content, in any form or by any means, except (i) as expressly permitted by this Agreement, (ii) with DiveLogs’s prior written permission, or (iii) as permitted under the fair use provision of the Copyright Act. Except as otherwise permitted in this Agreement, Subscriber shall not sell, license, sublicense or distribute Content (including printouts) to third parties or use Content as a component of or as a basis for any material offered for sale, license or distribution.

Rights in Content. Except for the license granted in this Agreement, all right, title and interest in Content, in all languages, formats and media throughout the world, including all copyrights, are and will continue to be the exclusive property of DiveLogs and other contributors (“Contributors”) of Content.

Disclaimer of Warranties and Limitation of Liability. EBOOKS AND CONTENT ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF PERFORMANCE, MERCHANTABILITY AND FIT- NESS FOR A PARTICULAR PURPOSE, ACCURACY, OMISSIONS, COMPLETENESS, CURRENTNESS AND DELAYS. DIVELOGS AND CONTRIBUTORS SHALL HAVE NO LIABILITY WHATSOEVER TO SUBSCRIBER FOR ANY CLAIM(S) RELATING IN ANY WAY TO THIS AGREEMENT OR THEIR PERFORMANCE HEREUNDER, REGARDLESS OF THE FORM OF ACTION, WHETHER BASED IN CONTRACT OR NEGLIGENCE. IN NO EVENT SHALL DIVELOGS OR CONTRIBUTORS BE LIABLE TO SUBSCRIBER FOR ANY CLAIM(S) OR OTHER CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Law
All disputes arising out of, or in connection with, any contract between the company and the buyer shall be governed by English Law and the buyer accepts the jurisdiction of the English courts.

Privacy and Data Protection:

Dive-Logs Ltd are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998 and General Data Protection Regulations 2018). We collect information about you for 2 reasons: firstly, to process your order and secondly to provide you with the best service possible.

Dive-Logs Ltd will be what’s known as the ‘Controller’ of the personal data you provide to us. If you use our site for purchasing stock products we only collect basic personal data about you which does not include any special types of information or location based information. This does however include name, address, email, IP address, and phone number. If you use our online dive log service then you may also supply location based information about your past or future dives. Additionally, if you use some of our designers to input your own content for the bespoke products we make just for you (for example Scubatags), you may enter any type of personal information you see fit for the eventual design and it's use.

Your Consent

By submitting information to Dive-Logs you consent to the collection and use of this information by Dive-Logs Ltd.

Why we need your data

We use the basic personal data you provide to enable us to process and fulfil your order and to notify you of the status of your request. We also ask for your telephone number which enables us to contact you urgently if there is a problem with your order.

If you have given explicit consent in advance, we will ocasioanally send you marketing emails about new products and services.

If you sign up to our online Dive Log service then we use your basic personal data plus any location based diving data to provide your dive log service.

If you provide any other form of personal data to be incorporated into a bespoke product, then we use that data solely for the purpose of production.

And finally, if you use our Scubatag contact service then any personal contact data you see fit to provide will be used to enable us to contact you in the event your scubatag is lost and found but for no other purpose.

What we do with your data

All the personal data we process is processed by our staff in the UK and for the purposes of IT hosting and maintenance this information is only located on servers within the UK. No 3rd parties have access to your personal data unless the law allows them to do so.

We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.

Improving Our Service

Dive-Logs Ltd does not sell, trade or rent your personal information to others. To better tailor our services to our customers' needs, we use non-identifying and aggregate information to help us make decisions on how to improve Dive-Logs.

Cookies

Cookies are alphanumeric identifiers that are transferred to your computer's (or alternative web browsing device’s) hard drive through your Web browser to enable our systems to recognise your browser and to provide rich shopping and visit features such as recommend products, and auto sign on, as well as the storage of items in your Shopping Basket between visits. The Help menu in most common browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie and how to disable cookies altogether. However, because cookies allow you to take advantage of some of Dive-Logs’s essential features, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you may not be able to add items to your Shopping Cart, proceed to Checkout, or use any Dive-Logs features that require you to Sign in. If you do leave cookies turned on, be sure to sign off when you finish using a shared computer.

Analytic Tools

Google Analytics is a system used by many websites to record information about visits to their website. Google set six different cookies with expiry dates ranging from 30 minutes to 2 years. These cookies are used mainly to differentiate between first time visitors to a website and repeat visitors. They also allow us to ensure our website performs as well as possible for our users. We do not use any personally identifiable data features of Google Analytics, instead relying solely on generic aggregated data. Social Media Plug-ins

Social Media Plug-ins for Facebook and Twitter obtain data for tracking purposes. This includes the ability to track an audience across devices for advertising purposes in line with the Terms of each social media platform and you own personal settings on those platforms. We do not serve any form of third party advert on our site, and will actively do what we can to limit your personal tracking to third parties when you visit us.

How long we keep your data

We are required under UK tax law to keep your basic personal data (name, address, contact details) for a minimum of 6 years. Any other data you provide may be kept longer to provide our full service (for example past Scubatag designs you have made and may wish to reorder, or the contents of dive data in your online dive log).

What we would also like to do with your data

We would however like to use your name and email address to inform you of our future offers and similar products. This information is not shared with third parties and you can unsubscribe at any time via phone, email or our website. We automatically assume you do not want to receive this communication. You must explicitly indicate your consent on your profile page or your order checkout page. At any time you can remove this consent.

What are your rights

If at any point you believe the information we process on you is incorrect you can request to see this information and have it corrected or deleted. If you wish to raise a complaint on how we have handled your personal data, you can contact us to have the matter investigated. contact@divelogs.com
